Transparent Legal Fees at Rosewood Law

At Rosewood Law, we believe that accessing expert legal advice should be straightforward, transparent, and affordable. We are committed to providing clear information about our fees from the outset, so you can make informed decisions with confidence.

Before we begin any work, we will explain our pricing, discuss the likely costs involved, and provide a clear estimate or fixed-fee quotation wherever possible. If your matter changes or becomes more complex, we will always discuss any additional costs with you before carrying out further work.

Fixed-Fee Legal Services

Many of our services are available on a fixed-fee basis, allowing you to know exactly what your legal costs will be before work begins. Fixed-fee services may include:

Actual rates will depend on the complexity and urgency of your matter. The VAT rate is currently set at 20%. Letters and telephone calls are charged at 1/10 of an hour. Hourly rates do not include any disbursements.

Disbursements

Some legal matters involve payments to third parties, known as disbursements. These are separate from our legal fees and are payable as required. Examples include:

As part of our regulatory obligations, we are required to undertake identity checks and Anti-Money Laundering checks for each client. We charge for this service as follows:

While we always aim to provide clear and transparent pricing, some legal matters are difficult to price on a fixed-fee basis due to their nature or complexity. In these cases, we will provide a realistic estimate of the likely costs based on the information available at the outset. As your matter progresses, if circumstances change or additional work becomes necessary, we will keep you informed, discuss any impact on costs with you, and obtain your approval before incurring further fees.

Our fees will not include any disbursements that may be required as part of your transaction.

Civil Litigation

This quote applies to cases where the value is up to £100,000.00. If you have a case where the value is more than £100,000.00, please contact us to discuss your case and for us to provide you with a personalised quotation.

Pre-Action

This means all steps before the case is at court. We would charge £500 to £1,500 (plus VAT and disbursements) for a simple case. If the matter is more complex:

  • Medium complexity case: £1,500 to £5,000 (plus VAT and disbursements)
  • High complexity case: £5,000 plus (plus VAT and disbursements)

The above fees are likely to include taking your initial instructions and instructions throughout, reviewing documentation and providing ongoing advice, undertaking appropriate searches, sending a letter before action, corresponding with the other party, and receiving payment and sending it on to you.

Factors that could make your matter more complex: a large volume of documentation to review; multiple parties; dealing with a litigant in person; if the debt is disputed or contested; if the other party indicates a counterclaim.

Proceedings

This relates to when the matter is at court.

  • Simple case: £2,000 to £10,000 (plus VAT and disbursements)
  • Medium complexity case: £10,000 to £15,000 (plus VAT and disbursements)
  • High complexity case: £15,000 plus (plus VAT and disbursements)

The above fees are likely to include: continuing to take instructions and further review; corresponding with the other party and relevant parties; preparing Claim Form and Particulars of Claim, or Defence; instructing and liaising with Counsel; applying to the court to enter Judgement in default; reviewing and advising on the other party's response; exploring and negotiating settlement; preparing for and attending mediation; preparing for and attending preliminary hearings and the final hearing; taking witness statements; reviewing and advising on the other party's witness statements; preparing document bundles.

Enforcement

This stage relates to when you have obtained an order in your favour and wish to enforce that order.

  • Simple case: £500 to £1,000 (plus VAT and disbursements)
  • Medium complexity case: £1,000 to £5,000 (plus VAT and disbursements)
  • High complexity case: £5,000 plus (plus VAT and disbursements)

The above fees are likely to include: advising on appropriate action; making further enquiries or searches; making appropriate applications; communicating with the other party and any relevant third party; negotiating repayment proposals.

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as Counsel's fees or travel/accommodation expenses. Possible disbursements include:

  • Court Fee for the issue of the Claim
  • Court Fee for hearing
  • Expert's fees
  • Barrister fees
  • Translators' fees
  • Mediator's fees
  • Fee to instruct the County Court bailiff or a High Court Enforcement Officer (enforcement stage)

How Long Will Your Matter Take?

The time from taking your initial instructions to the final resolution of your matter depends largely on the stage at which your case is resolved and the court in which proceedings have been issued. Litigation matters are highly dependent on other parties' involvement, so it is difficult to give an actual timescale.

  • If a settlement is reached during Stage One, your matter is likely to be resolved within three months.
  • If your matter progresses to Stage Two and to a final contested hearing, it is likely that the matter will take up to 12 months to resolve. Unfortunately, at present, the courts have a backlog of work and matters are being delayed considerably.
  • If Stage Three is required, we would hope that the matter could be resolved within three months of commencing enforcement action.

If there are any additional stages relating to your case, we will provide you with a quote for that stage. Our prices may change if your case becomes complex or has additional requirements — a matter becomes complex when we are required to draft witness statements, undertake a disclosure exercise, or involve experts. If that occurs, we will provide a realistic estimate of the likely costs based on the information available at the outset.

Timescale: we anticipate this could take up to 6 months to get a final resolution.

Our fees or above quotation do not include the Land Registry registration fee and stamp duty. This will be case dependent. When we provide our quotation we will be able to provide you with an indication of what that could be.

Stamp Duty Land Tax (SDLT)

This depends on the purchase price of your property. You can calculate the amount you will need to pay by using HMRC's website, or the Welsh Revenue Authority's website if the property is located in Wales.

Since 1st April 2025, purchases by first-time buyers are exempt from SDLT if the purchase price is below £300,000. If this applies to you, you will not be required to pay the Stamp Duty detailed above. To count as a first-time buyer, a purchaser must not, either alone or with others, have previously acquired a major interest in a dwelling or an equivalent interest in land situated anywhere in the world.

We will act as your "tax agent" for the purposes of SDLT in connection with your purchase. This means we will complete the Land Tax Return form on your behalf and submit it online. By agreeing to our terms and conditions, you are also agreeing to authorise us to enter the date of completion of your purchase as the effective date of the transaction. We will submit the form electronically to HMRC, together with your payment of the tax due, immediately after completion.

We do not provide tax-related advice; you should seek independent advice from a financial advisor.

Leasehold Property

If the property you are buying turns out to be leasehold, there will be an additional fee of £250 plus VAT for us to deal with the additional queries in relation to this tenure.

Properties with Management Companies

If you are buying a property which requires you to pay a service charge, we will be required to obtain information from your seller's Management Company. Our charges for reviewing this information are £150 plus VAT.

Shared Ownership

If you are purchasing your property on a shared ownership basis, there will be an additional legal fee of £250 plus VAT for the additional works and registration formalities involved.

How long will my house purchase take? The average process takes between 12–16 weeks. It can be quicker or slower, depending on the parties in the chain. If you are a first-time buyer purchasing a new build property with a mortgage in principle, we have been able at times to complete these within a week. Leasehold properties that require a lease extension can take significantly longer — months rather than weeks.

Other Chargeable Factors

Onboarding Fee

We charge an onboarding fee of £55 plus VAT per client to comply with our regulatory requirements. This includes undertaking checks in connection with Anti-Money Laundering, identification verification and sanction list checks.

Gifted Deposit

If you are receiving a gifted deposit from a family member or another party, we will have to carry out additional checks on the identity of the donors and the source of these funds. There will be an additional fee of £100 plus VAT payable upon completion for each donor. Your lender may require a bankruptcy search against each person making the monetary gift — bankruptcy searches are £8.80 per person, plus an onboarding charge of £20 plus VAT per person.

Surveys

If the property is a new build, a survey is not really necessary as the property will have the benefit of a new-build guarantee (e.g. Zurich or NHBC) which guarantees the structure of the property. If you have a mortgage lender assisting you with your purchase, they will carry out a valuation of the property as part of your mortgage application.

Searches

Although we obtain the local search, it is important to realise the limitations on the result of the search. Whilst some matters — for example possible road developments within 200 metres of the property — are covered, no planning information that does not specifically relate to the property you are acquiring will be revealed. If you are concerned about possible development in the surrounding area, you should contact the local planning authority directly.
